Terms & Conditions

These Terms and Conditions govern the rental of charcuterie carts, slushie machines, and related services provided by Gourmamie, LLC  (referred to as "we," "us," or "our") to the client (referred to as "Client," "you," or "your"). By booking our services, you agree to be bound by these terms.

 

1. Booking and Reservation

 

  • Minimum Booking Notice: All bookings are subject to availability and require a minimum notice of 14 days prior to the event date. Shorter notice may be accommodated subject to a rush fee.

  • Deposit: A non-refundable retainer/deposit of  25% of the total cost is required to secure the date and rental items. No booking is confirmed until the deposit and a signed contract (or acceptance of these T&Cs) are received.

  • Final Payment: The remaining balance is due 5 days prior to the event date. If the final payment is not received by the due date, we reserve the right to cancel the booking without refunding the deposit.

 

2. Cancellation and Changes

 

  • Client Cancellation:

    • Cancellations made 10 days or more before the event date will forfeit the non-refundable deposit.

    • Cancellations made less than 3 days before the event date will forfeit the full rental fee (100% of the total cost).

  • Date Changes: We will make every effort to accommodate date changes. Changes are subject to availability and may incur a change fee if made less than 10 days prior to the original date.

  • Force Majeure: We are not responsible for cancellations or delays due to events outside of our reasonable control (e.g., severe weather, acts of God). In such cases, we will work with you to reschedule, but refunds are not guaranteed.

 

3. Rental Period and Equipment Use

 

  • Rental Duration: The rental period will be specified in the booking agreement and covers delivery, setup, use during the event, and takedown/retrieval.

  • Charcuterie Cart: We will set up the cart and grazing table prior to guest arrival. The Client is responsible for ensuring food safety standards are met after setup (e.g., monitoring temperature) and must dispose of all food items and waste promptly after the event.

  • Slushie Machine: The Client is responsible for operating the machine as instructed. We provide clear operational guidelines upon setup.

  • Location Access: The Client must ensure clear, easy access to the event location and the appropriate power source (for the slushie machine) is available upon our arrival.

 

4. Damages and Responsibility

 

  • Damage Waiver/Security Deposit: A refundable security deposit of $100 may be required to cover potential damage to the rental items (cart, machine, serving ware, etc.). This deposit will be refunded within 7 days after the event, provided all items are returned clean and undamaged.

  • Client Liability: The Client assumes all responsibility for the rental equipment from the time of setup until the time of retrieval. The Client agrees to pay for the replacement cost of any lost, stolen, or severely damaged equipment (beyond normal wear and tear).

  • Indemnity: The Client agrees to indemnify and hold harmless [Your Business Name] from any claims, damages, liabilities, and expenses (including legal fees) arising from the Client’s use of the rental items or any food-related issues that occur after our delivery and setup is complete.

 

5. Governing Law

 

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Colorado.
